Do You Need a Permit to Remodel a Kitchen or Bathroom in Houston?

Before the remodel: the golden oak kitchen, Houston, TX

“Do I need a permit?” is one of the most common questions Houston homeowners ask before a remodel. The honest answer is that it depends on what the work includes and where you live. There is no single rule that every kitchen or bathroom remodel needs a permit, or that none do. Here is how to think about it.

It depends on the scope of work

Permit requirements are usually tied to what is actually being changed, not to the word “remodel”. Cosmetic updates such as painting, new cabinet doors or replacing a countertop are often handled very differently from work that changes a home’s structure or its plumbing, gas or electrical systems. Even within those systems, whether a particular change needs a permit can depend on the details of the work and the rules of the jurisdiction.

Questions that typically come up when a permit is being considered include:

  • Are any walls being removed, opened up or moved?
  • Is plumbing being relocated or added, or is a fixture being replaced in the same place?
  • Is there any gas line work?
  • Are electrical circuits being added or changed?

The answers to these questions, together with your local rules, decide what is required for your project.

It depends on where you live

The City of Houston has its own permitting rules and process. Many homes in the Houston area are not inside the city: West University Place, Bellaire, Sugar Land and the Memorial Villages such as Bunker Hill Village and Piney Point Village are separate cities with their own requirements, and homes in unincorporated areas follow county rules. Many neighborhoods also have HOAs or deed restrictions, which usually focus on exterior changes.

Because the rules differ from place to place and change over time, the most reliable source is your city or county building department. Fees and review times vary with the jurisdiction and the size of the project.

Why it is worth getting right

  • Safety: where inspections are required, they confirm that regulated work meets code.
  • Insurance: work that should have been permitted but was not can complicate a claim.
  • Selling your home: buyers, inspectors and appraisers may ask about past renovations.

Questions to ask your remodeler

Rather than assuming, ask your contractor to walk you through it: which parts of your scope may require a permit in your city, who is responsible for applying for it under your contract, and how inspections would fit into the schedule. A good remodeler will answer these questions clearly and in writing. If a permit is legally required for your work, it should be obtained.
